This ties in kinda with a post I wrote about since Pot isn't legal at the federal level even if it is Medical how does the taxes work.......
Pot Shops Can’t Take American Express or Deposit in Banks

Every month, Elliott Klug or one of his business partners walks into the Colorado Revenue Department with a messenger bag holding thousands of dollars in cash and watches as state employees start counting.
Klug, co-founder of PinkHouse Blooms LLC, a chain of five medical-marijuana dispensaries in Denver, has to pay his sales taxes in cash because federal law bars banks from offering accounts to pot shops, even as Colorado allows and taxes them.

“It highlights the awkward situation we’ve been placed in,” Klug, 36, said by telephone. “We are paying taxes, but despite our best efforts to be good citizens, we’re still paying in cash.”
Colorado is among 18 states that allow the medical use of marijuana, and 11 that permit sales through dispensaries like Klug’s. But federal law labels the drug a controlled substance and requires banks to report related transactions as suspicious activity. The inconsistency creates a gray area for dispensary operators, who have to choose between operating as a cash-only business, susceptible to robbery, or finding creative ways to open checking accounts and accept credit and debit cards.
“They’re encouraging cash operations, which are a threat to public safety, and much more difficult to track and audit,” Aaron Smith, executive director of the Washington-based National Cannabis Industry Association, said by telephone, referring to the conflicting rules.
Dispensaries pay federal, state and local taxes, in addition to state and local licensing fees “that often run up to tens of thousands of dollars annually” and many government agencies don’t accept cash, Smith said.
Seeking ‘Solution’
“We’re just looking for a solution where we can bank legitimately like any other industry,” Smith said. “Wherever you stand on the marijuana issue, it serves everybody’s interest to have banking access.”
Klug said that until 2011 he had checking accounts with Wells Fargo & Co. (WFC), which “welcomed us with open arms and then changed their minds.”
San Francisco-based Wells Fargo, the fourth-largest U.S. bank by assets, “opted not to bank these businesses in view of the complex and inconsistent legal environment,” Jim Seitz, a spokesman, said by e-mail. The bank conducts regular internal reviews and “if we identify a situation in which a policy is not being followed correctly, we act accordingly,” he said.
Klug now uses cash to pay about $45,000 a year in licensing fees to the state and remits about $35,000 a month in sales taxes to Denver and the state.
Innocent-Sounding
Some dispensaries get around the rules by setting up a shell business with an innocent-sounding name and not divulging that it’s tied to medical marijuana, said Dale Gieringer, director of the California office of the National Organization for the Reform of Marijuana Laws, a pro-pot group. California was the first state to legalize medical-marijuana use in 1996.
“As long as the bank doesn’t find out, you should be safe,” Gieringer said by telephone. “Or you can use a family account or a personal account. Some people have another business on the side and they use that account.”
If the subterfuge is discovered, “the bank terminates services with no explanation,” Gieringer said.
Bank officials say they are complying with federal law.
At Wells Fargo, “our policy of not banking marijuana dispensaries is based on applicable federal laws and our own assessment of our responsibility,” said Seitz, the bank’s spokesman.
Credit Cards
Similarly, American Express Co. (AXP), the biggest U.S. credit-card issuer by customer purchases, “has made a decision to not allow card acceptance for medical marijuana,” Sanette Chao, a spokeswoman for the New York-based company, said by e-mail. “It is our policy to adhere to federal law in such matters.”
Some financial institutions look the other way.
“There are some locally owned banks that medical marijuana companies are utilizing,” Daria Serna, a spokeswoman for the Colorado Revenue Department, said by e-mail.
Banks risk losing their deposit insurance or their federal charter if they violate the law, said Robert Rowe, senior counsel at the American Bankers Association, a Washington-based industry trade group.
Under federal law aimed at preventing money laundering, “banks are supposed to know their customers,” Rowe said by telephone. “One of the expectations is banks will do some checking into their customer and what kind of business they are doing.”
‘Suspicious Activity’
The Federal Deposit Insurance Corp., which insures customer deposits at U.S. banks and regulates some state-chartered banks, “has advised regional and field staff that banks should file Suspicious Activity Reports on transactions and deposits related to proceeds from the sale of controlled substances,” Greg Hernandez, a spokesman for the Washington-based agency, said by e-mail.
“It is the FDIC’s expectation that banks conduct prudent due diligence regarding their customers and should know and understand the types of businesses the customers operate,” Hernandez said. “Knowing that cashflow comes from an illegal activity should raise concerns of bank management, who is expected to evaluate the account relationship to determine whether the account should be maintained or terminated.”
At The Joint, a Seattle-based medical-marijuana dispensary, founder Shy Sadis said he has an account with “one of the top banks in the United States” and has an automated-teller machine on site for his customers to get cash.
“We do payroll for all of our employees,” Sadis, 40, said by telephone. “It’s crucial to have a bank account. If we didn’t, we would be underground, dealing with cash and not paying our taxes.”
Regulatory Framework
In Washington, where voters last year legalized recreational use of marijuana, the Liquor Control Board is designing a regulatory framework for the new industry that includes a 25 percent tax on producers, processors and retailers.
Businesses paying in cash would present a security issue, said Brian Smith, a spokesman for the board.
“We’ll need to be prepared to accept potentially large amounts of cash,” he said. “Do we suddenly have to have armored-truck service? That’s a potential.”
Scott Jarvis, director of Washington’s Financial Institutions Department, took the issue to regulators at the FDIC and the Federal Reserve in March.
‘Make Decisions’
“The purpose was to let my federal counterparts know that we had passed the initiative, that the state was moving forward in fulfilling the will of the people and that when push comes to shove, money has to go somewhere into the banking system,” Jarvis said. “And to alert them that at some point somebody will have to make some decisions.”
Still, Jarvis said his agency will probably issue guidelines reminding financial institutions of the federal law.
“We have a lot of banking and credit-union folks that are interested in providing banking services to this industry,” Jarvis said.
“I think we’ll have some resolution either through policy at the federal level or through the court system,” Jarvis said. “Also, Congress could act.”
U.S. Representative Jared Polis, a Colorado Democrat, in February introduced a bill to remove marijuana from a drug classification known as Schedule I, or most dangerous, where it is listed alongside heroin.
“We want to make sure they have access to the same type of banking facilities as other businesses,” Polis, who said he doesn’t smoke pot, said by telephone.
Federal Response
States are also looking to U.S. Attorney General Eric Holder, who said in March that the Justice Department is considering a response to voter approval of recreational marijuana use in Washington and Colorado.
In both states, anyone 21 and older can legally possess as much as 1 ounce (28 grams) of marijuana for recreational use. Nonmedical retail sales remain illegal until the new rules are in place.
In Colorado, lawmakers this week approved bills to regulate and tax recreational pot purchases. A task force on implementing the law recommended that the legislature consider all alternatives to help businesses access banking services.
“Efforts are needed either to secure a federal exemption for legal marijuana businesses in Colorado to be able to legally bank with federally insured banks, credit unions and other financial institutions, or to create a local financial institution that is not subject to federal regulation,” the task force said in a report.
Once recreational-marijuana retailers open shop, there will be some small banks that will accept their business either publicly or through “willful blindness,” said Robert McVay, a lawyer with Seattle-based Harris & Moure PLLC, which has helped medical-marijuana dispensaries open in the state.
“The business is there and whoever steps into it is going to do well,” McVay said.

I have no Anthem Pictures cause I was still in line for tickets when they or whom ever sangthem sang.. There was a part of the game I didn't get.. Guy got hit the pitch and didn't get to take a base but a new batter came in for him.......

Empty Buffalo and food trucks damit damit ......
Recently the food truck battle has been raging in Amherst and I don't agree with Amherst but an ugly truth has come up again and it is what was used as part of the anti casino movement and those people had kinda a point .....
YES The FOODTRUCKS are a boom to the ELMWOOD AREA when they are there and yes they do bring people to where they are however and this isn't a bash on them it is a bash on the burbs and our current world.....
On Saturday I went to the bank and it dawned on me how long as Mode been empty ? The bar part was open it re opened clossed.... The names have changed .... Glad there is a Joe's Deli across from the bank coming some time but how long was that house front open for years....
I admit that I don't shop that much on Elmwood.....
When I was a kid Grant St. got all the place with these Gorgeous Black and Gold maybe bronze or Platnum is more correct signs and it was a boom... Well for a few years... Now there is a movement to bring Grant St. back and there are some great places... Buff State is right there it should be... And Amherst is taking off..... But yet a place closes on Elmwood and sits empty for years ...... Not good.......
I've heard Hertel is the new hip place to be ? Heard a rumor that we might get a sisster site or maybe someone was just going to by the name for one or change the name....HA
See that "Hip Factor" that "Buzz" the "It Factor" the "Cool" the "Social Media show up there" is what some of those sit down places fear... They can't keep up with that and never can.........
The new build up is the Waterfront.... Yeah the waterfront is great and should have been great years ago.... But Buffalo isn't Toronto :( Grant St. Elmwood , Hertel, Amherst (The street that connects them to each other lets call it the gateway :) OH ) and The Waterfront all can't be connected by business .... Buffalo just doesn't have the people.... Maybe if you count the burbs but they have there own little towns :)
When I was a kid we ate at The Hatch if at that part of the waterfront and not the other way in Tonawanda .... Then it was onto the Ice Cream that dripped faster then you could eat it..... Near front park it was teds or they had a stand... Watch out for the birds they would steel your food....
But there is a part of me that wonders if say a Mr. Frosty truck or some other company pulled up what would that have done to the ice cream place would it still be open ?
Unless Buffalo brings in more people everything can't stay open ..... That is the ugly truth..... Not enough people and enough money... I still think we are going in the right direction but think we will all ways be a pocket city... We are a small city we aren't NYC, Toronto or any where else....
My point isn't that I really have one... But that we don't have enough resources to support everyone that runs a good place in Buffalo we just don't..............

random thoughts
-so woke up today and went off to the bank still not really 100% awake got a can of Kickstart that did seem to help some
-Not use to the sun it feels good out there makes it feel warmer then it is... most times i'm up before it and it isn't that bright when heading home or maybe I'm awake by then so.......
-There is still something hot as wrong as this is about girls with hair up pajamas and hoodie of some kind ... Maybe if she just rolled out of bed she would roll back in with me ?
---that being said still not as hot as Yoga Pants oh my thank you for whom ever came up with those.. not as good as the tight jeans that show off the front as well but any one who wears the yoga pants it shows off and makes what ever they have back there look good... Didn't see any on the strip though....
-Lost my train of thought what was I talking about next
-Once I wake up ??? going to work on my place or try to so tough to know where to start some times.........
-Now at work Prioties I can see so well gotta do this then that... Hey why is that person doing that no that is wrong gotta do this first why are they slowing me down ... ARGH ARGH FUCK..... I'm sure I missed something I all ways do since thoughts come when not at a computer.... Yeah really need to get like some type of smart phone that is tough rugged has a great camera and won't tie me up for 2 years if the cell service sucks... with real or truely unlimeted up loads so I can do the mobile thing ...... but how long have I been saying this ?

Legal ? Tax ? questions ?
So Today at work one of those ads played on the radio about "Do you need help in protection from the IRS"... There are many forms of those ads and who knows what ones are legit... At least this one didn't mention $10,000 and how they can stop forclosure and them taxing property and your stuff....
So that reminded me of how the IRS kicked in Willie Nelson's door and took all his stuff... But isn't willie nelson a big advocate for Pot so then that got me thinking about taxes....
Weed has been made legal in some states ... Now it is illegal at the federal level... Now I don't know if there are any stores yet... But since it is legal wouldn't sales tax (Assuming those states have it) go to the state... But what about federal tax.... Now since someone is selling it ... It would be counted as Income ? Wouldn't it... It is legal in the state but not federally but would it still be income at the federal level ? If so do the feds get any money from it? It is income? Even though it isn't legal at the federal level is not giving them their tax illegal...... Can one give them their cut and not say what it is from ? If you Document it do you have to say what it is from ? If you pay your tax will they leave you alone ? These are all things to think about... This isn't only a weed thing though what about other things that might be illegal at the Federal level... As an example if you are married to someone of the same sex and the state gives you benifits that the federal government (say medical insurance or some kind of aid) doesn't say are yours cause they don't recongize the marriage don't you have to pay tax on that ? I know it sounds silly but when everyone went after Al Capone they never got him except for tax evasion ... If he documented everything and not said what it was and paid his taxes would the IRS have left him alone??? Granted that might have proven he was guilty of crimes but.......
Here is my other or next thought... some states have medical marjauna as legal and have dispenceries ... But again the drug is still illegal at the federal level and them selling it to people with scripts is illegal at that level.. But when you pay someone in wages to work there or maybe even deliver it to produce brownies or other types of food those people and companies make a wage... I assume again that tax goes to the state... But what about paying into say if one wanted to a 401K can one do that... ? Again anyone who owns one or whom pays people do you take out federal taxes like paying into medicad... It is a legal legit buisness but acording to the feds so do you pay them taxes ???
I'm just wondering if any one knows? I'm not talking at all about things on the street in either case... I'm talking about a legit buisness....
This same question might hold true for porn ... Cause it isn't really legal.... Prostution isn't legal in Vegas like people think it is... Street walkers aren't paying taxes.... But there are places where brothels are legal like Moonlite bunny Ranch (Think that is in carson ? Wish I knew not that I even have the money for Vegas let alone one of those women).... This might be a bad example cause prositution might be left up to the states if you don't take the person over a state line... Not sure how that works.... But if it is looked at as a federal crime would one pay taxes on it... The girls make money.... The House makes money everyone there gets paid... The girls are regiesterd with the state and have to get tested every so often might be 30 so highly regulated and hopefully keeps everyone safe... So I assume the Feds would like there money... Is not giving them their money a crime?
Sorry for the no proff read.... Also spell check doesn't work in Chromo or IE ... In the past they both show up with the redline (not currently on chrome) but they give no suggestions maybe it is a windows 8 thing or maybe you need a seprate app ? Not sure but just some things to ponder and think about......
Not to mention...... I don't have all the details but that internet tax is making the news again....

Reality MTV
1. I have kinda covered this topic before and not sure what I said or how I will say it now
2. I've been a bad (e:Peep) lately haven't been reading I love the site still of course but I sometimes forget to come here to read and keep up plus the site is back to being pretty active :)
I don't have all the details since I don't watch MTV as much as I once did but the movie awards are on tonight and I think they are on live.. Some years taped some years live think it is live this year.... It is all ways an event Sure Twilight will win everything ...HA but that isn't what I'm here to write about but gotta give them credit for awards that also lead to hot moments like Best Kiss (Oh gawd I'm on Twitter so much my hands want to type hashtags infront of every topic), Best villian and Most Anticapted movie that isn't out yet....
Today there is a Buckwild marathon on... For those that don't know (Assuming anyone reads this) Buckwild follows young adults in West Virgina ... It is kinda like the real world and kinda like Jackass they are country so for at least one person there have been sub tittles ....
For those that may not know two of the people from the show have made the news.. The most recent is Shaine (not sure how he spells it there are a few ways it could be spelled) who died with a couple others in a mudding accident... From what I read MTV had started filming season 2 all ready not sure how far along they where... This wasn't caught on film... MTV didn't film any of the funeral or that kind of stuff... I think they where asked not to and I think they paid for the funearal or some of it at least.... MTV decided to stop shoting and there is no season ...... They say cause Shaine was such a big part of the show.. But really how could we watch after that as a viewer ????????
I'll be honest I have no idea what the 8pm Listed as NEW through my cable box Buckwild half hour show will be... Think it is like the cast reflecting back on Shaine and highligts of him from the show... But it doesn't sound like that...
Now Then what is the Point??? Yeah good question.....
I like Realtiy TV and Documentaries... But I don't see how the cameras being there can't effect it... As someone who likes to take pictures .. I'd like to think that a quick snap catches that moment and I think it does.. But when you have a sound pack on and a camera crew to report to.. It has to have an effect even if they just follow......
But where things get more muddy is that I know there are things on TheRealWorld like no TV or if there is it has to be stuff they have the rights to.. There are only certain places they can film so it does effect how people live and act... Alcohol in the house.. But I don't know how much of that is true in Buckwild or where they follow.. I great example was TheRealOC . What made that show so amazing is there where like no Parents but what really made it feel so fun is that The school said you can't shoot here... So I just wonder how the cameras fit in with buckwild since I don't know....
.......The Point that leads to is if the cameras do effect what the young adults did then is MTV responsible ? Well yeah kinda.. I'm not saying if they are or not... But the next question is what about the fame factor? In other words once you are this person on TV and people see you out and about does it put pressure on you to be that person on TV? I don't know.............
...........Also Does The TV show encourage you to do more stunts or act a certain way? Yes there are people I'm sure who go those stupid rednecks can't wait till I see them all get blown up and die on TV... But there are also people that think the show is great so you get praise for the things you do... Does that encourage you to do more of ....? If it does than does that mean MTV is a factor in the death.....
These are just thoughts things that one should and can think about and wonder about I'm not saying I have all the answers... As much as I would love to see a season 2 think MTV is correct in not shooting the show anymore... Unless of course the people on the show ask them to keep filming......
The ?s I'm asking aren't new to BuckWild... The real world I think was first a show over in Europe and it worked so they brought it here.. and the same ?s could be asked then? Also over in Europe there was a show called Queer As folk that lead to the show over here.. The led to "TheLWord" that lead to "The Real L Word" ... That for those that don't know is a show on show time.. Yeah there is drama yeah there is hot lesbian sex, some stright sex and did I mention lots of drama... It makes great TV but I wonder how much the cameras effect that show... As an example one of the people one of the people on the show plays music and because of the show has a bunch of followers and that is how she gets her music out... On a side note .. At least one of the people from that show will be in Buffalo for Pride at Roxy's and yeah it is sponorsed by the show.. Sorry I have no idea if they will be filming... But that is a good example lets say The Stripteasers where to be someplace and they are filming would they do there best show ever ? Would people who think they will be on TV dress a bit nicer... Would the burlesque girls dancing in front of the stage care about the cameras would more hope up to be on tv if they where fiming ?
Again just something to think about........
One of the things about the News and reality TV is that I think it causes a breakdown in what is real... There is this new show on HBO called vice.. It is really good and they go to these dangerous place with a film crew and it is really good.. But at the same time it is entertainment... So line get blured a little bit....
The other thing is death in the news... It is like there is this fire and 3 people die and it is told the same way in the same tone as the weather and the sabres... So it is like 3 people dying is equal to how the our sports team does... Cause it is reported the same... So the depressing stuff and the good news is all told to us the same way... I admit I don't know what the effect it is... But If you thought Johnathen Winters as was an example was very funny... His death should make you cry... Yes we all take the blame in this when we post to facebook and twitter... I'm not saying it is only on the news... But they do set the tone so.....
I didn't proff read this so some stuff may not make any sense... and there isn't really a point just some thoughts......................

Openning Day and hating the life right now...
So we are all brought up different ... I never liked how I was brought up but feel like I can't change how I was... I wouldn't say I was the dirty kid... Wierd Kid sure.. Tough to explain I'm naturally messy and all ways spill food all over the place but maybe that is a new thing.. But I'm also very visual as well so when I want something I kinda need to know where it is .. I have to be able to see ... These two things makes for a very messy place.....
Now when I bought my own computer one of the reasons was so that I could do things like pictures and being on line at the same time as TV so I could do other things and have more time.... Took some time to get to that point....
So at work I saw I had marks on my arm had no idea what they where at all... I do physical work looked like my arm broke out in some form... So after time someone told me I had bed bugs on my coat... ARGH not work.. So I've been doing some cleaning get the place a lot better... Things like washing and drying clothes to kill them and bag them up.... I think before I knew I had them not sure I Infected my mothers place .... I paid her to get her place sprayed it was supposed to happen today.... We where supposed to go to opening day for her birthday ... I'm still going and with extra tickets will sit by my self they don't want to take the chance that is fine......
Now I've been spraying and killing them and doing what I can... But the thing is that ... I have video tapes, photo albums, stuff I collect stars wars and stuff and dressers on walls and my land lord said no.. on bringing in an exterminator... Everything has to be off the wall... I don't have the room yet.... Grumble Grumble... Hoping to get there by end of April we shall see..... My orginal goal before I knew I had bugs was Sunday... to have people over for wrestlemania but the bugs killed that idea grumble grumble.... So I can't go to anyones house or have anyone over..
Now I'm ok with this if and when I get things good enough I can get things in the middle...
Now some of you may know I have a sisster but she isn't on here and for good reason I didn't tell her.. She is Drama.. Yeah Drama.... When she was a kid tantrums and as long as I stayed at parents I moved out cause I couldn't stand her and parents going at it... Plus I needed a place you know for "Company" and stuff... Doesn't mean I don't love her.. But she is a bitch a lot of the time... I blame a lot of it on parenting but that is just mean... And that ugly ness rooted its head tonight.......
I'm sitting on line reading some #Twitter (Why did I do the hashtag that makes no sense) and Facebook as I'm watching ABC family lineup and she mesages me... I mean yelling at me about how I have to throw all my stuff out get an exterminator (yeah caps bitch argh) and how I'm picking my stuff over Family.. I need to start over with a new place and get rid of all my stuff... Couldn't take it so I just logged out we shall see what other messages she sends... ARGH not looking foreward to it..... Oh yeah about how I'm taking them to work and how I can't go any place in public... I do spray and check the coat everyday....ARGH.
Now I have for some time felt like burning it all down and kinda starting again .... But it isn't like I can move to NYC and find a job or say Charollete or something.... Besides I don't have money for new stuff and what if I get rid of every thing and my photos get infected those can't be replaced ? ARGH ARGH.... I guess this is it... But I wish I could just start over again.. But see I've been single for so long it messes with your mind..... And also with out roomates the place gets out of whack real quick or can... One can't just throw out bank statements and pay checks with SS numbers... ARGH.....
Yeah nothing like be yelled at and bitched at when one is trying to relax that is why I keep to my self so much... I can't deal with this shit... But I think I'll be ok...ARGH.... OK lost my point... Oh yeah sorry if anyone is reading this my spell check doesn't work and when it does it only tells you it is wrong and not any suggestions.... Oh yeah hoping if I get enough done that I might be able to get stuff to the middle of each room we shall see...
Ok onto better stuff go Bisons.. They are now the farm team of the Toronto Blue Jays ... I know they have some new stuff or changes at Coca-Cola field but not sure what... Hoping to make it through entire game it will be cold..............
